This Privacy Policy explains how CAPSE Inc. ("CAPSE", "we", "our", or "us") collects, uses, stores, and shares information when you use our AI voice agent platform and related services (the "Services").

We serve two types of people: Customers (businesses that purchase and configure our Services) and End Users (individuals who interact with our AI voice agents on behalf of or independently of our Customers). This policy applies to both.

1. Information we collect

1.1 Information from Customers

When you sign up for CAPSE as a business, we collect:

  • Account information: company name, business email, billing address, and payment details

  • Configuration data: voice agent settings, call routing rules, escalation logic, and CRM integration credentials

  • Usage data: number of calls handled, call durations, agent performance metrics, and API activity logs

  • Communications: emails, support tickets, and messages you send to us

1.2 Information about End Users (callers)

When an End User interacts with a CAPSE-powered voice agent, we may process:

  • Call audio and transcripts: recordings of the conversation, transcribed to text for the agent to understand and respond

  • Caller ID and phone number: used to match the caller to existing CRM records if our Customer has configured this

  • Information provided during the call: name, account number, issue description, or any other details the caller shares verbally

  • Metadata: call time, duration, language detected, escalation outcome, and device type (where available)

Note: CAPSE processes End User data as a data processor on behalf of our Customers, who act as data controllers. Our Customers are responsible for ensuring they have the appropriate legal basis to use CAPSE with their callers.

1.3 Information collected automatically

When you visit our website or use our platform, we automatically collect:

  • Log data: IP address, browser type, pages visited, and timestamps

  • Device information: operating system, screen resolution, and language settings

  • Cookies and similar tracking technologies (see Section 7)

2. How we use your information

We use the information we collect to:

  • Deliver the Services: process calls, route escalations, generate transcripts, and sync data with CRM systems

  • Improve our models: analyze anonymized, aggregated call patterns to improve AI accuracy and response quality. We do not use identifiable call content to train models without explicit Customer consent.

  • Manage your account: billing, authentication, and Customer support

  • Send communications: product updates, invoices, security alerts, and (with your consent) marketing emails

  • Comply with legal obligations: respond to lawful requests from government authorities and enforce our Terms of Service

  • Ensure security: detect fraud, abuse, and unauthorized access

We work with trusted third-party providers to deliver our Services, including cloud infrastructure, telephony providers, and analytics tools. All sub-processors are contractually required to handle data according to our security and privacy standards. A current list of sub-processors is available upon request.

3. How we share your information

We do not sell personal information. We share data only in the following circumstances:

3.1 With sub-processors

We work with trusted third-party providers to deliver our Services, including cloud infrastructure, telephony providers, and analytics tools. All sub-processors are contractually required to handle data according to our security and privacy standards. A current list of sub-processors is available upon request.

3.2 With our Customers

Call transcripts, metadata, and caller information are shared with the Customer whose voice agent handled the call. Customers control how this data is used within their own systems.

3.3 For legal compliance

We may disclose information when required by law, court order, or to protect the rights and safety of CAPSE, our Customers, or the public.

3.4 Business transfers

If CAPSE is acquired, merged, or undergoes a change in ownership, your information may be transferred as part of that transaction. We will notify you before any such transfer takes effect.

Customers may configure shorter retention windows. Upon account termination, we delete or anonymize Customer and End User data within 60 days, unless we are required by law to retain it longer.

5. Your rights

Depending on where you are located, you may have the following rights regarding your personal data:

  • Access: request a copy of the personal data we hold about you

  • Correction: ask us to fix inaccurate or incomplete information

  • Deletion: request that we delete your personal data ("right to be forgotten")

  • Portability: receive your data in a structured, machine-readable format

  • Objection: object to certain types of processing, including direct marketing

  • Restriction: ask us to limit how we process your data in certain circumstances

  • Withdraw consent: where processing is based on consent, you can withdraw it at any time

For End Users (callers): If you interacted with a voice agent powered by CAPSE, your data is controlled by the business that deployed the agent — not directly by CAPSE. Please contact that business first. If you are unable to reach them, contact us and we will assist where possible.

6. International data transfers

CAPSE operates globally. Your data may be transferred to and processed in countries other than your own, including the United States. Where required, we rely on appropriate safeguards for international transfers, including:

  • Standard Contractual Clauses (SCCs) approved by the European Commission

  • Data Processing Agreements with all sub-processors

  • GDPR-equivalent protections for EU and UK users

By using our Services, you acknowledge that your data may be transferred internationally in accordance with this policy.

7. Cookies

We use cookies and similar technologies on our website for:

  • Strictly necessary: session management, authentication, and security

  • Analytics: understanding how visitors use our site (via anonymized analytics tools)

  • Preferences: remembering your settings and language

We do not use advertising cookies or share cookie data with ad networks.

You can manage cookies through your browser settings. Disabling certain cookies may limit some website functionality.

8. Security

We implement industry-standard security measures to protect your data, including:

  • Encryption in transit (TLS 1.2+) and at rest (AES-256)

  • Role-based access controls and audit logs

  • SOC 2 Type II compliance (Enterprise tier)

  • Regular third-party security assessments

9. Children's privacy

Our Services are not directed at children under the age of 16. We do not knowingly collect personal information from children. If you believe we have inadvertently collected such data, please contact us and we will delete it promptly.

10. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page

  • Notify Customers by email at least 14 days before the change takes effect

  • For significant changes, require acknowledgment before continued use of the Services

Continued use of the Services after changes take effect constitutes acceptance of the updated policy.
